You must be enrolled in an HSA-qualified plan (referred to in the law as a High Deductible Health Plan) to become HSA-eligible

Your HSA passes to your husband or wife if you name your spouse as beneficiary.

If you name anyone else as your designated beneficiary, the HSA ceases to be an HSA as of the date of your death.

Your HSA can continue to pay your eligible expenses after your death.
